1. INTRODUCTION AND ACCEPTANCE

Welcome to the Instant Estimate Tool provided by Orange Contracting and Appraisal Inc. DBA Orange Contracting and Roofing ("Company," "we," "us," or "our"). By accessing this website, entering your property information, and clicking "Get Quote," "Submit," or any similar button, you ("User," "you," or "Property Owner") expressly acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms").

2. NATURE OF THE TOOL: PRELIMINARY ESTIMATE ONLY

The pricing information generated by this tool is a non-binding preliminary estimate ("Estimate").

  • 2.1. Informational Purposes: The Estimate is a price range calculated based on generalized data provided by you (e.g., rough square footage) and historical market averages. It is provided solely for informational and budgeting purposes.
  • 2.2. Not an Offer: The Estimate does NOT constitute a legally binding offer, quote, bid, or contract to perform work at the stated price. No contract is formed until a formal, written Construction Agreement is signed by both you and an authorized representative of the Company following a physical inspection.
  • 2.3. Subject to Inspection: You acknowledge that an accurate price cannot be determined without an on-site inspection to assess specific variables including, but not limited to: roof pitch, layers to be removed, decking condition, flashing, ventilation, and site accessibility.

3. PRICING VALIDITY AND MARKET FLUCTUATIONS

All pricing generated by this tool is subject to change without notice. Final pricing will be determined by current material costs (e.g., lumber, asphalt, metal) and labor rates at the time a formal contract is executed. The Company reserves the right to correct any errors or omissions in the Estimate.

4. INSURANCE CLAIM SUPREMACY CLAUSE

IMPORTANT NOTICE FOR INSURANCE CLAIMS:

Orange Contracting and Roofing specializes in insurance restoration. You expressly acknowledge and agree to the following regarding insurance-related projects:

  • 4.1. Invalidity of Web Estimate: If you engage the Company to assist with or perform work related to a property insurance claim, the Estimate provided by this tool is rendered NULL AND VOID. The web-based Estimate is calculated for retail/cash projects and does not reflect the comprehensive scope of work, code upgrades, and pricing structures (e.g., Xactimate) required for insurance restoration.
  • 4.2. Governance of Insurance Scope: In the event of an insurance claim, the final contract price will be determined solely by the scope of loss approved by your insurance carrier, plus your deductible and any necessary supplements. You agree that the results of the insurance claim adjudication supersede any prior Estimate received via this website.
  • 4.3. Supplements: Insurance claims often require "supplements" for additional labor or materials discovered during production or omitted from the initial adjuster's estimate. These are separate from the Estimate provided by this tool.
  • 4.4. No Assignment of Benefits: We comply with Florida law regarding Assignment of Benefits (AOB). We do not require you to assign your post-loss benefits to us. You retain control of your claim rights.

5. USER REPRESENTATIONS

By using this tool, you represent that:

  • You are the owner of the property entered or have express legal authority to inquire about improvements for said property.
  • All information provided (contact info, address, roof details) is accurate and complete. The Company is not liable for Estimates based on incorrect user data.

6. CONSENT TO CONTACT (TCPA & FLORIDA TELEMARKETING ACT)

By submitting your information, you agree to the following in compliance with the Telephone Consumer Protection Act (TCPA) and Florida Statute § 501.059:

  • 6.1. Express Written Consent: You provide your prior express written consent for Orange Contracting and Roofing to contact you at the telephone number and email provided.
  • 6.2. Automated Communications: You authorize us to contact you using automated technology, including automatic telephone dialing systems (autodialers), prerecorded voice messages, AI-generated voice, and SMS/MMS text messages, even if your number is listed on a Do Not Call registry.
  • 6.3. Purpose: Communications will relate to your estimate, scheduling inspections, project updates, and marketing of our services.
  • 6.4. Opt-Out: Consent is not a condition of purchase. You may revoke this consent at any time by replying "STOP" to any text message or contacting us directly.

7. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY FLORIDA LAW, ORANGE CONTRACTING AND APPRAISAL INC. DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE ACCURACY OR RELIABILITY OF THE TOOL. WE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE TOOL OR RELIANCE ON THE ESTIMATE.

8. FLORIDA STATUTORY DISCLOSURE (FLA. STAT. § 489.147)

THE CONSUMER IS RESPONSIBLE FOR PAYMENT OF ANY INSURANCE DEDUCTIBLE. IT IS INSURANCE FRAUD PUNISHABLE AS A FELONY OF THE THIRD DEGREE FOR A CONTRACTOR TO KNOWINGLY OR WILLFULLY, AND WITH INTENT TO INJURE, DEFRAUD, OR DECEIVE, PAY, WAIVE, OR REBATE ALL OR PART OF AN INSURANCE DEDUCTIBLE APPLICABLE TO PAYMENT TO THE CONTRACTOR FOR REPAIRS TO A PROPERTY COVERED BY A PROPERTY INSURANCE POLICY.

9. DISPUTE RESOLUTION

Any dispute arising out of or relating to these Terms or the use of the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Construction Industry Arbitration Rules. The venue for any such arbitration shall be Orange County, Florida. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT.

PRIVACY POLICY

1. INFORMATION COLLECTION

We collect information you voluntarily provide, including your name, address, phone number, email address, and project details. We may also collect technical data such as your IP address to verify consent for communications.

2. USE OF INFORMATION

We use your data to:

  • Generate the requested Estimate.
  • Contact you regarding your project and our services.
  • Comply with legal obligations (e.g., retaining proof of consent).

3. NO SALE OF DATA

We do not sell your personal information to third parties. Your data is used exclusively by Orange Contracting and Roofing and our trusted service providers (e.g., CRM software) to assist you.

4. DATA SECURITY
